Any different or additional Terms or Conditions in Buyer's purchase order or similar communication are objected to and shall not be binding on the Seller unless to in writing, by Seller's authorized signature. Buyer's acceptance of shipment or performance and/or payment for the goods or services constitutes acceptance of the Seller's Terms and Conditions. ...At Hotel Supply Store we will always try our utmost to make your shopping experience as simple and hassle free as we can, and we will try to help wherever possible.

   ACKNOWLEDGMENT AND ACCEPTANCE OF TERMS
   This Web Site is owned and operated by HSS Distribution , LLC dba as Hotel Supply Store  (Reg. in Missouri, USA).
   By accessing, browsing or using this Web Site, you agree to these terms, conditions and disclaimers as amended from time to time ("Terms and Conditions") and acknowledge that you have read and understood these Terms and Conditions. By purchasing any goods from this Web Site or directly form our company via electronic media (email) or by fax, [and/or by completing the registration form to become a Registered Customer], you expressly agree to be bound by these Terms and Conditions. Hotel Supply Store reserves the right to amend the Terms and Conditions at any time. Any amendment will be effective immediately. Your continued use of this Web Site after any amendment constitutes an agreement by you to comply with and be bound by the amended Terms and Conditions. This agreement shall be binding upon and insure to the benefits of the parties hereto, their respective successors and permitted assigns. In absence of an original, a fax executed copy of this contract or electronic mail shall act as an original.
2. QUOTATIONS SUBJECT TO CHANGE: All quoatations are subject to change due to fluctiations in the price/or availability of any material and or/labor charges. Quotations are based upon mnaufacturingin one lot and one time of all quantity which has been quotated. In the event that paprtial shipment are made and/or the goods are manufactured in more than one lot, the Seller reserves the right to adjust its price accordingly.
3. ORDER ACCEPTANCE : Buyer's order must be documented by this Terms and Conditions, signed Proposal, signed Purchase Order, Signed Sbmitted drawinfs, payment, signed Proforma/Sales order, invoice, signed confirmation by electronic mail. No order will be considered binding unless these documents are received.
4. ORDER CHANGES: All orders are especiall fabricated in accordance with the Buyer's signed order or electronic email. Buyer shall send any requests for changes to Seller, promptly and in writing.Buyer must obtain signed verification from Seller that the change request was received and accepted in order for the change to be valid. If the requested changes result in pricing changes to the order, Seller will produce a " Change Order" documenting such changes. The Buyer must sign and return the Chnage Order for the change(s) to be become a valid part of the processing the Change Order. Seller will not be responsible for any delay in fabrication or shipment caused by Change Orders made at a point in time whereby the completition of the Change Order would cause delay in the completion of the Order.
5. ORDER CANCELLATION FOR CUSTOM OR SPECIAL ORDERS: lf the Buyer wishes to cancel the Purchase Order after the Seller receives the payment, but before the Seller proceeds with submittals, the Seller will refund but 25% of the contract total. After the Seller starts submittals to the factory, the Seller will accomadate the cancellation, but the Seller will NOT refund the money paid. after the Seller custo finish for the Buyer's Order, this Order may NOT be cancelled, and the Seller require payment in full.
6. SPECIFICATIONS: Unless otherwised agreed in wrting, the Purchase order will be manufactured to the Industry Standards, pubished tolerances and variations.
7. ORDER CHANGES: Prices in effect at time of shipment of goods or performance of services shall prevail. All prices quoted by the Seller are subject to change without notice unless otherwise stated in writing. The Seller reserves the right to revise the quotation out of validity of quotation if the Seller does not receive the order for all items quoted, since quantity frequently governs the price. If federal, state or any other special sales or excise tax is applicable, then such tax will be changed to Buyer and must be paid by Buyer.
8. REFUNDS: We will refund or replace any goods that may have arrived at the destination in unusable or faulty condition or indeed different from those ordered. You must notify or return the items to us within 5 days of receipt. You also have the right to cancel your order at any time before delivery and within 3 days after the day of receiving your goods. Should you decide to request a refund, please notify us immediately by emailing hotelsupplystore@sbcglobal.net in the event of cancelling your order within the timeframe mentioned above you will be responsible for the cost of returning your goods to us in a saleable condition (that is unopened and unused) after 5 working days the sale is considered closed and we will not make a refund. Your statutory rights are not affected.
9. PAYMENT /CREDIT TERMS: Seller's Credit Department, at its sole discretion, shall have the right to approve and assign Buyer credit, set terms limits, set payment terms and modify or terminate Buyer's credit privileges at any time. Unless Seller notifices Buyer otherwise, the following terms will apply: (A) Specifially fabricated orders or non-stock itemsfor current customers will require a 50% to 100% deposit at the Seller's discretion before fabrication/production can begin and the balance will be paid before the date of delivery. Once Seller orders " Special Order Goods" the Buyer shall be financially liable for payment of the sales price for such items. Seller shall not be responsible for projects/factory/manufacturer delays due to Special Order Goods availability and/or delivery. Buyer may NOT cancel any order that has been custom finished or cut to size for Special Order item. (B) Buyer agrees that all current obligations shall become immediately due and payable in the event of (1) Buyer's failure to accept a comleted order when ready for shipment or pickup (2) Buyer's failure to pay debts as they becoime due (3) Buyer's failure to comply with Seller's credit or payment terms (d) Buyer's dissolution, bankruptcy, insolvency, or death (4) termination of the contract by Buyer for any reason is an breach of contract. Please note that: the shipment of orders paid on line by Credit Cards or Pay Pal will only be released from our warehouse once the payment has been received by our bank. Please allow 3-4 working days for proper credit and verification by our bank of credit card and pay pal transactions. 
10. RETURN OF GOODS: We will always accept any return of goods when the packaging is intact or the items have been re-packed to an acceptable standard allowing the re-sale of the product. Should the product be faulty or not to specification, we will, replace or refund or replaced by a comparable product.
    Goods may be returned at the expense of the customer if they are ordered in error or not suitable providing they have not been used and are packaged.
    Goods which are made to order, used goods (by consumer) washed or laundered linen or cut piece goods are non returnable.
    We operate on a fair and flexible basis and will always look into any query in order to help our customers.
11. DELIVERY: All deliveries are FOB Sellers facility unless otherwised stated. Neither Freight charges nor tax is subject to any discount. risk of loss or damage in transit shall be borne by Buyer, and claims shall be made directly with carrier.
12. FORCE MAJEURE: The Seller shall not be laible to Buyer or to any third parties for whose use any of Buyer's orders is intended for any penalties, damages, claims, or any other losses occassioned by Seller's failure to make delivery, or delay in making a delivery of an Special Order when such failure or delay results from causes or events beyond Sellers reasonable control (a "FORCE MAJEURE EVENT") , including but not limited to fires, floods, storms, hurricanes, casualty losses, accidents, or other acts of God, stress, labor disputes or difficulties, acts or requirements of Government delay or difficulty, or inability to obtain labor or raw materials or approval drawings which are not timely returned by the Buyer or Buyer's architect or representative. However, the Sellers shall inform thids force majeure event immediately to the Buyers by e-mail or fax.
13. PARTIAL SHIPMENTS:To expedite arrival of products to the customer, Hotel Supply Store.com reserves the right to divide orders into separate shipments based on product availability. In cases where a portion of an order's items are shipped separately, the customer will not be responsible for any additional shipping fee.
14. USER INFORMATION: All information provided by you when you place an order with us is referred to in these Terms and Conditions as "User Information". When you provide any User Information you are representing and warranting that all of the information provided is true and correct and you agree to indemnify Hotel Supply Store for any losses, costs, expenses or damages that Hotel Supply Store may suffer if any of this information is not correct.
    You should also review the Hotel Supply Store Privacy Statement on this Web Site for further information concerning our collection and usage of User Information. By sending us your User Information, you agree to grant Hotel Supply Store the right to disclose aspects of your User Information as expressed in the Hotel Supply Store Privacy Statement.
